I, the undersigned (“Volunteer”), acknowledge that I am voluntarily providing services as a volunteer for an event, training session, competition, workshop, or activity organized, hosted, promoted, or facilitated by KML Movement LLC, doing business as Xpand Your Limits (“XYL”), including any affiliated entities, directors, officers, employees, contractors, coaches, officials, and fellow volunteers, and any independent hosting, satellite, or partner gym or facility (“Host Facility”).).

1. Voluntary Participation

• I understand and agree that:

  • My participation as a volunteer is entirely voluntary

  • I am not an employee, agent, or contractor of XYL or any Host Facility

  • I am not entitled to wages, benefits, insurance, or compensation of any kind

  • Any perks, apparel, meals, or incentives provided are discretionary and not compensation

  2. Assumption of Risk

  I understand that volunteering at XYL events involves inherent risks, including but not limited to:

  • Physical activity, lifting, spotting, loading, equipment handling, and event setup/teardown

  • Exposure to weights, bars, racks, flooring, and athletic equipment

  • Interaction with athletes, spectators, and other volunteers

  • Environmental conditions including heat, cold, weather, noise, and crowd conditions

  • Risk of slips, falls, strains, collisions, serious injury, illness, or death

  I knowingly and voluntarily assume all risks, whether known or unknown, foreseeable or unforeseeable, arising from my volunteer activities.

  3. Medical and Personal Responsibility

  I represent and affirm that:

  • I am physically and mentally capable of performing volunteer duties

  • I will disclose any medical condition that could affect my safety

  • I understand XYL and Host Facilities do not provide medical care beyond basic first aid

  • I am solely responsible for my own medical expenses

  • I am not under the influence of alcohol, drugs, or substances that impair my judgment or ability

  I understand that I may stop volunteering at any time if I feel unsafe.

  4. Release and Waiver of Liability

  In consideration of being permitted to volunteer, I hereby release, waive, discharge, and hold harmless:

  • KML Movement LLC (dba Xpand Your Limits)

  • All affiliated companies and entities

  • Event directors, organizers, officials, coaches, contractors, and volunteers

  • Any Host Facility and its owners, operators, employees, and contractors

  from any and all claims, demands, actions, damages, losses, costs, or liabilities, including those arising from negligence, related to my volunteer participation, to the fullest extent permitted by law.

  5. Indemnification

  I agree to indemnify, defend, and hold harmless XYL and any Host Facility from any claims, damages, liabilities, or expenses (including attorneys’ fees) arising from:

  • My actions or omissions

  • My violation of this Agreement

  • Any injury or damage I cause to persons or property

  6. No Supervision or Employment Relationship

  I acknowledge that:

  • Host Facilities are independent entities

  • XYL does not control or supervise Host Facility premises or equipment

  • This Agreement does not create an employment, partnership, or agency relationship

  7. Media Release

  I grant XYL the irrevocable right to photograph, record, and use my name, image, likeness, and voice in any media format for promotional, marketing, educational, or commercial purposes, without compensation or additional consent.

  8. Code of Conduct

  I agree to:

  • Act professionally, respectfully, and safely

  • Follow all instructions given by XYL event leadership

  • Refrain from unsafe, disruptive, or inappropriate behavior

  XYL reserves the right to remove any volunteer at its sole discretion.

  9. Serverability

  If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

  10. Governing Law

  This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio.

  11. Acknowledgment & Signature

  I acknowledge that:

  • I have read and fully understand this Agreement

  • I understand I am waiving substantial legal rights, including the right to sue

  • I am signing this Agreement voluntarily

  I certify that I am 18 years of age or older, or that a parent or legal guardian has signed on my behalf.
